Autopsy of a Contract - 3 Hour Elective - Classroom

This course dissects a contract and the law that necessitates it. The following will be covered: review standard definitions contained within contracts, review fiduciary duties applicable to licensees, the Statute of Frauds, requirements for writing and identify minimum requirements/elements to form a contract, identify required language and why it is required to include in contracts, agreements and disclosures, discuss the impact of counter-offers, review Priority of Offers Standards of practice expected of licensees, review Termination of offers, discuss Iowa Administrative Rules for contract presentations, explore contractual defenses for performance, review rules of contract construction, review the judicial rules of contract interpretation, analyze sample contractual language currently utilized by many
